The Divorce Process

If you’re getting a divorce, it’s helpful for you to understand the process so you’ll know what to expect.

You have to have been married for at least one year before you can get a divorce, and you’ll need to prove that your relationship has “irretrievably broken down”. The ‘Grounds for Divorce’ can be demonstrated by 5 facts:

  • adultery
  • unreasonable behaviour
  • 2 years separation with consent from both you and your spouse
  • 5 years separation
  • desertion

It’s important to get legal advice as soon as possible after the relationship breakdown to make sure that the divorce proceedings are issued appropriately. It’s also helpful if you and your spouse can agree on the grounds for divorce – this can potentially save a lot of time and money.
